HUD Investigates SunTrust FHA for Origination Practices

SunTrust PersonalBanking is under investigation by HUD regarding its FHA loan origination practices. HUD made its investigation known to the Atlanta-based bank in late April, and in a recent filing, the bank said, ├â┬ó├óÔÇÜ┬¼├àÔÇ£The Company is cooperating with the investigation.├â┬ó├óÔÇÜ┬¼├é┬Ø (At the time of this publication, SunTrust could not be reached for further comment.) According to the filing, HUD├â┬ó├óÔÇÜ┬¼├óÔÇ×┬ós investigation pertains ├â┬ó├óÔÇÜ┬¼├àÔÇ£generally to origination practices for FHA loans.├â┬ó├óÔÇÜ┬¼├é┬Ø Multiple news reports confirmed in June that HUD had issued subpoenas to SunTrust, MetLife, and U.S. Bancorp regarding FHA loan originations.

Refinance Applications Rise Highest Since January

Mortgage applications went up 0.2 percent last week as refinance volume rallied at levels not seen for the past several years. The Mortgage Bankers Association found the refinance share of mortgage activity ticking up to 81 percent of total application volume, the highest since January this year, while the Refinance Index climbed 0.8 percent to its highest level since April 2009. The increase in refinance activity also saw a 6 percent decline in government refinance applications. The adjustable-rate mortgage share of activity declined to 4.1 percent of total volume.

Mortgage Applications Drop as Interest Rates Post New Lows

Mortgage applications decreased 6.7 percent over the week ending June 19, while interest rates also fell, finding new lows in some categories, according to the Mortgage Bankers Association. Refinances still make up a majority of applications ├â┬ó├óÔÇÜ┬¼├óÔé¼┼ô 78 percent for the week, slightly lower than the 79 percent share recorded the previous week. The amount of refinance applications fell 8 percent over the week. HARP 2.0 refinance applications stood at 20 percent three weeks ago but have been at 24 percent for the past two weeks.

FHA Backtracks on Homebuyer Credit Dispute Requirements

HUD rescinded guidance Friday that would have obligated homeowners to resolve debts outstanding of $1,000 or more or enter into a repayment plan by closing time for a mortgage backed by the Federal Housing Administration. Guidance from February required that lenders with homeowners in dispute of credit accounts or collections in that amount resolve or pay down the debt in order to meet eligibility criteria for a FHA-insured loan. That policy would have gone into effect by July 1, although earlier guidance remains.

Wells Fargo to Streamline Refinance Only In-House Loans

Wells Fargo recently announced that it will accept refinance applications for homeowners with FHA mortgages only if their loans are serviced in-house by the mortgage lender. Vickee Adams, a spokesperson for Wells, said in an e-mailed statement that the lender currently services more than 500,000 customers with FHA home loans that could qualify to save money by refinancing under changes at the agency. The lender will start accepting only refinance applications for in-house loans on Tuesday.

FHA to Go Forward With Delinquent Loan Sale to Investors

HUD Secretary Shaun Donovan and Federal Housing Administration Acting Commissioner Carol Galante announced in a press conference Friday FHA's program to sell mortgage loan pools to investors. The Distressed Asset Stabilization Program, designed to give homeowners with seriously delinquent loans a chance to avoid foreclosure, is an expansion of an earlier FHA pilot program that allows investors to purchase loan pools headed for foreclosure. Investors are then charged with the task of working to bring the loan out of default. The program starts in September 2012 with a sale of the loan pools.

Slight Uptick in Applications Driven Solely by Refinances

Mortgage applications increased 1.3 percent on a seasonally adjusted basis in May, according to the Mortgage Bankers Association's latest mortgage application survey released Wednesday. The survey measured application data for the week ending June 1 and included an adjustment for the Memorial Day holiday. On a non-seasonally adjusted basis, application rates were not as strong, falling more than 9 percent from the previous week. Refinances continue to make up a large portion of mortgages, taking up 78 percent of activity for the week, up 1 percent from the previous week.

Obama Administration Pushes for New Refinance Expansions

The Obama administration made another push Friday to expand refinancing opportunities for homeowners, with HUD Secretary Shaun Donovan behind the effort to adopt any one of three bills currently in Congress. Officials told reporters in a teleconference Friday that President Barack Obama would appear with a family in Nevada later that day to tout the need for a wider refinance net. The HUD secretary outlined three bills before Congress that seek to streamline the refinance application process and increase servicer competition by reducing barriers.

HUD Reaches $202M Settlement With Deutsche Bank

HUD announced Thursday that it reached a $202 million settlement with Deutsche Bank and Mortgageit over allegations of misconduct and false certifications with a government lender program. The agency said that Mortgageit acknowledged and accepted responsibility for false certifications it submitted to HUD in order to gain from a direct lender program under the Federal Housing Administration. For its part, Deutsche Bank admitted wrongdoing by failing to account for Mortgageit's activities when personnel with the financial institution were in a place to know about them.

Mortgage Applications Increase Modestly, Largely Flat

Mortgage applications went up last week as most other measures of application activity declined or stayed flat, according to the Mortgage Bankers Association. The trade group found that mortgage application crept forward by 1.7 percent on a seasonally adjusted basis and 2 percent on a seasonally unadjusted basis. Government applications fell for purchases and conventional loans. Purchase indices ticked up 3.5 percent from the week before on 5.4 percent increase in conventional purchases. The Government Refinance Index dipped by 2.3 percent.
