Report: BofA Mortgage Settlement at an Impasse

Ongoing settlement negotiations between Bank of America and the Justice Department reportedly reached a stalemate Monday. Citing "people briefed on the matter," the New York Times reported late Tuesday that the offer fell far short of the record $17 billion that prosecutors are seeking to resolve the state and federal investigations. BofA is seeking to continue negotiations while the government finishes readying its petition to file in federal court.

Report: BofA, Feds Negotiating $12B Settlement

Citing reports from "people familiar with the negotiations," the Wall Street Journal reported late Thursday that Bank of America has been working fervently over the week to come to an agreement with the Justice Department and put an end to speculation on the potential size of the settlement. Though the final numbers remain unconfirmed, if true, the settlement would rival last year's historic $13 billion paid by JPMorgan Chase to resolve similar allegations.

Despite Declines, Originator Rankings Little Changed in Q1

The decline in mortgage production in the year's opening months failed to produce any names to the list of top lenders for the quarter, but it did shake up the rankings a bit. Staying firmly in the No. 1 spot for the quarter was Wells Fargo, which held on to 14.3 percent of the market with $36 billion in origination volumes, down from $50 billion in Q4 2013. On the servicing side, Wells Fargo again beat out all others, boasting a portfolio estimated at $1.81 trillion.

Settlement Monitor: Most Banks Meeting Compliance Reqs

According to examination results released Wednesday by the Office of Mortgage Settlement Oversight, five of the six banks met or exceeded expectations across 29 different compliance metrics in the third and fourth quarters of 2013. Not faring as well was Green Tree, a wholly owned subsidiary of Walter Investment Management Corp., which has part of ResCap's servicing portfolio.

FHLBank Advances Surging Among Largest Institutions

Secured loans, or advances, from the Federal Home Loan Banks system to lenders dried up significantly after the market crash of 2008, when the loans peaked at about $1 trillion. But since then, advances have risen to $492 billion, largely due to a flood of secured loans to the system's four largest members—JPMorgan Chase, Wells Fargo, Bank of America, and Citibank. These lenders accounted for $135 billion of the contributions through 2013.

Mounting Legal Expenses Eat Up BofA’s Earnings

Legal expenses took a substantial bite out of Bank of America’s first-quarter earnings, resulting in a net loss of $276 million to start the year. “The cost of resolving more of our mortgage issues hurt our earnings this quarter,” said Brian Moynihan, CEO of the North Carolina-based megabank. “But the earnings power of our business and customer strategy generated solid results and we continued to return excess capital to our shareholders.”

BofA, FHFA Settle in $9.3B Agreement

Bank of America has agreed to a multibillion settlement with the Federal Housing Finance Agency (FHFA) to resolve allegations of securities fraud related to loans sold to Fannie Mae and Freddie Mac at the height of the housing bubble. Under the agreement, BofA will make an aggregate payment of approximately $9.33 billion, $3.2 billion of which will go toward the repurchase of certain RMBS at fair market value.

Mortgage Settlement Banks Fulfill Relief Requirements

The appointed monitor for the National Mortgage Settlement revealed Tuesday that all banks involved in the settlement have satisfied their consumer relief and refinancing obligations—and nearly a year ahead of schedule. In a release, Joseph A. Smith Jr. commented, "Because of the way this landmark agreement was designed, an unprecedented amount of relief has been provided to consumers quickly and efficiently."

2013 Originations Down 14%; Wells Fargo Stays on Top

While mortgage origination volumes looked different last year compared to 2012, the list of top lenders looked very much the same. In full-year originations, Wells Fargo held on to its top spot, generating approximately $351 billion in loans—about 19 percent of last year’s total volume, according to Mortgage Daily. JPMorgan Chase followed up at No. 2 at $168 billion.
